Welcome to GratifID. These Terms of Service ("Terms") govern your use of the GratifID platform, including our website, mobile applications, NFC devices, and all related services (collectively, the "Service"). By using GratifID, you agree to these Terms.
Please read these Terms carefully. If you don't agree with these Terms, please don't use our Service.

1. Acceptance of Terms
By creating a GratifID account, purchasing or using any GratifID NFC device, or accessing our Service in any way, you agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and GratifID, Inc.
If you are using the Service on behalf of a business or organization, you represent and warrant that you have authority to bind that entity to these Terms.
2. Eligibility
You must be at least 18 years old to use the GratifID Service. By using the Service, you represent and warrant that you:
- Are at least 18 years of age
- Are legally permitted to use payment processing services in your jurisdiction
- Will comply with all applicable local, state, national, and international laws and regulations
- Have not been previously suspended or removed from the Service
3. Account Registration
To use the Service as a service worker, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4. The Service
GratifID provides a digital tipping platform that enables customers to tip service workers using NFC technology and mobile payment systems (Apple Pay, Google Pay). The Service includes:
- NFC-enabled physical tags (wristbands, keychains, buttons, cards)
- Mobile application for workers to manage tips and payouts
- Payment processing infrastructure powered by Stripe
- Analytics and reporting tools
- Customer support services
GratifID is a platform that facilitates tipping transactions. We are not an employer, staffing agency, or party to the employment relationship between workers and their employers.
5. Fees and Payment
Transaction Fees: GratifID charges a transaction fee of 5.9% + $0.30 per tip transaction. This fee covers payment processing (Stripe fees) and GratifID platform services.
Hardware: Your first GratifID NFC tag is provided free of charge during our early access period. Replacement tags and additional tags are available for a nominal fee.
No Monthly Fees: There are no monthly subscription fees, setup fees, or cancellation fees.
Fee Changes: We reserve the right to modify our fee structure with 30 days' advance notice to registered users.
All fees are clearly displayed before you complete registration. By using the Service, you agree to the applicable fees.
6. NFC Devices
GratifID NFC tags remain the property of GratifID until fully paid for. You are responsible for:
- Proper use and care of your NFC device
- Reporting lost or stolen devices promptly through the app
- Not modifying, tampering with, or attempting to circumvent the security features of NFC devices
- Using devices only in connection with the GratifID Service
You may deactivate a lost or stolen NFC device through the GratifID app at any time. Deactivated tags will not process tips.
7. Tips and Payouts
Tip Processing: Customer tips are processed immediately through Stripe's payment infrastructure. Funds are held in your GratifID account pending payout.
Payout Methods:
- Standard transfers: Free next-business-day ACH transfers to your linked bank account
- Instant transfers: Available via Stripe's instant transfer feature at Stripe's applicable fee (currently 1.5% with $0.25 minimum)
Payout Requirements: To receive payouts, you must provide valid banking information and complete identity verification as required by applicable law and our payment processor.
Tax Reporting: We will provide Form 1099-K to users who receive more than $600 in tips in a calendar year, as required by IRS regulations. You are solely responsible for reporting and paying all applicable taxes on your tip income.
Chargebacks: In the event of a payment dispute or chargeback, we reserve the right to withhold the disputed amount pending resolution.
8. User Conduct
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Process fraudulent transactions or engage in money laundering
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Engage in any activity that is harmful, deceptive, or misleading
- Use the Service for any purpose other than legitimate gratuity payments
Violation of these conduct rules may result in immediate account suspension or termination.
9. Intellectual Property
The GratifID name, logo, platform, software, and all associated intellectual property are owned by GratifID, Inc. and are protected by applicable intellectual property laws. You may not:
- Copy, modify, or distribute any GratifID content without written permission
- Use GratifID trademarks or branding without authorization
- Reverse engineer or attempt to extract the source code of our software
- Create derivative works based on the Service
10. Termination
By You: You may terminate your account at any time by contacting us at info@gratifid.com. Upon termination, any pending payouts will be processed to your linked bank account within 5-7 business days.
By Us: We reserve the right to suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in fraudulent activity
- Fail to provide accurate identity or banking information
- Create risk or legal liability for GratifID
Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will remain in effect.
11. Disclaimers and Limitations
No Warranty: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRATIFID SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE.
Maximum Liability: Our total liability to you for any claims arising from use of the Service shall not exceed the total fees paid by you to GratifID in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless GratifID, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
13. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Send notification to your registered email address
- Display a notice within the GratifID app
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Bexar County, Texas.
