Terms of Service

Welcome to GratifID. These Terms of Service ("Terms") govern your use of the GratifID platform, including our website, mobile applications, NFC devices, and all related services (collectively, the "Service"). By using GratifID, you agree to these Terms.

Please read these Terms carefully. If you don't agree with these Terms, please don't use our Service.

1. Acceptance of Terms

By creating a GratifID account, purchasing or using any GratifID NFC device, or accessing our Service in any way, you agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and GratifID, Inc.

2. Eligibility

To use GratifID, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information
  • Maintain a valid payment method for receiving tips

Service workers under 18 may use GratifID with parental or guardian consent and supervision.

3. Account Registration

3.1 Account Creation

To use GratifID, you must create an account by providing:

  • Your full legal name
  • Valid email address
  • Phone number
  • Payment account information (for receiving tips)
  • Any other information required for identity verification

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

3.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update your information to maintain its accuracy. False information may result in account suspension or termination.

4. The Service

4.1 What GratifID Does

GratifID provides a universal tipping identity platform that enables service workers to accept digital tips via NFC technology. Our Service includes:

  • NFC-enabled physical devices (wristbands, tags, cards, etc.)
  • Digital tip processing infrastructure
  • User dashboard and analytics
  • Payout management
  • Customer support

4.2 Service Availability

We strive to provide 99.9% uptime but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues
  • Factors beyond our control

We are not liable for any losses resulting from Service interruptions.

5. Fees and Payment

5.1 Platform Fees

Free Plan:

  • Platform fee: 2.9% per transaction (plus Stripe processing fees)
  • No monthly subscription fee
  • One free NFC device
  • Standard payouts (2-3 business days)

Pro Plan ($4.99/month on annual subscription):

  • Platform fee: 2.9% per transaction (plus Stripe processing fees)
  • Monthly subscription: $4.99 (billed annually at $59.88)
  • 5 NFC devices free per year
  • 3 free instant payouts per month (additional instant payouts available for fee)
  • Advanced analytics and custom tip pages

5.2 Payment Processing

All payments are processed through Stripe, Inc. By using GratifID, you also agree to Stripe's Terms of Service and Privacy Policy. Stripe fees are separate from GratifID platform fees.

5.3 Refunds

Subscription fees are non-refundable except as required by law or at our sole discretion. Tips received through the platform are final and cannot be refunded by GratifID (disputes must be handled between you and the tipper).

6. NFC Devices

6.1 Device Ownership

Upon full payment, you own the physical NFC device. However, the device remains tied to your GratifID account and the Service. The device has no independent value without the Service.

6.2 Device Care

You are responsible for:

  • Proper care and maintenance of your NFC devices
  • Loss, theft, or damage to devices
  • Replacement costs for damaged or lost devices

6.3 Device Warranty

NFC devices come with a 90-day limited warranty against manufacturing defects. This warranty does not cover normal wear and tear, misuse, or accidental damage.

7. Tips and Payouts

7.1 Tip Processing

When a customer taps your GratifID device:

  • The tip is processed through Stripe
  • Platform fees (2.9% + Stripe fees) are deducted
  • The net amount is credited to your account
  • You receive an instant notification

7.2 Payout Schedule

Free Plan: Payouts occur every 2-3 business days

Pro Plan: Instant payouts available (3 free per month, then fee applies)

7.3 Minimum Payout

Minimum payout amount is $1.00. Tips below this threshold accumulate until the minimum is reached.

7.4 Tax Responsibility

You are solely responsible for reporting and paying all applicable taxes on tips received through GratifID. We provide annual earnings statements to assist with tax filing.

8. User Conduct

You agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any local, state, national, or international law
  • Impersonate another person or entity
  • Attempt to circumvent platform fees
  • Reverse engineer, decompile, or hack our Service
  • Use automated systems to interact with the Service
  • Harass, abuse, or harm another person
  • Engage in fraudulent activity of any kind
  • Collect or store personal data about other users

Violation of these terms may result in immediate account termination and legal action.

9. Intellectual Property

All content, features, and functionality of the GratifID Service, including but not limited to:

  • Software, code, and algorithms
  • Text, graphics, logos, and images
  • The GratifID name and branding
  • Design and layout

...are owned by GratifID, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting support. Upon termination:

  • Your access to the Service will cease
  • Your NFC devices will be deactivated
  • Any pending payouts will be processed according to the standard schedule
  • Subscription fees are non-refundable

10.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • We suspect fraudulent activity
  • Required by law
  • You create risk or legal liability for us
  • Your account has been inactive for 12+ months

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 No Guarantee of Earnings

We make no guarantees about your earnings through the Service. Your tips depend on your customers, service quality, and factors outside our control.

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRAFITID SHALL NOT BE LIABLE FOR:

  • Lost tips, earnings, or profits
  • Service interruptions or errors
  • Data loss or corruption
  • Unauthorized access to your account
  • Third-party actions (including Stripe)

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless GratifID, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws

13. Changes to Terms

We may update these Terms from time to time. When we do:

  • We'll update the "Last Updated" date at the top
  • We'll notify you via email or Service notification
  • Continued use of the Service constitutes acceptance
  • Material changes will require your explicit consent

It's your responsibility to review the Terms periodically. If you don't agree to the updated Terms, you must stop using the Service.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

14.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive your right to participate in class action lawsuits.
